By accessing, browsing, or using this Site, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions (“the Terms and Conditions.

These Terms and Conditions govern your (“the User”) use of the K-Beauty House (“Provider”). Website domain name www.k-beautyhouse.co.za (“the Website”).

Governing Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.

Membership
The Site is available to registered users who are 18 years and older. We reserve the right to revoke your membership for any reason at any time including as a result of a violation of these Terms of the Privacy Policy, without notice. Membership is void where prohibited by law.

Payment Options
Payment may be made via credit card (Visa or MasterCard) via PAYFAST, this website does not store or maintain a credit card list. PAYFAST provides a secure connection for any account transactions. You may also pay by electronic fund transfer (EFT) into the Provider’s bank account, the details of which are provided on receipt of order via email once order is complete.

Credit card acquiring and security
Credit card transactions shall be acquired from the Provider via approved payment gateways. The User’s payment gateways use the strictest form of encryption, namely Extended Validation SSL with 256-bit encryption and 3D Secure. 3D Secure is an extra layer of security in using your credit card for online transactions. For online transactions over R1000 you’ll be asked to enter your 3D Secure password (different from the PIN), which is called Verified by Visa and MasterCard Secure Code by the respective credit card companies. No credit card details are stored on the Website.

Customer and credit card details
The User’s (Customer) details shall be stored by the Provider separately from card details.

Delivery
Subject to stock availability with suppliers and receipt of payment, online purchases shall be processed within 1-2 working days and handed over to a courier company for delivery. Orders shall be delivered to the nominated physical address (not Postal Boxes) when the User completes the order online and full payment has been received.

The Provider shall supply all goods to the delivery company in good order and shall do its utmost to ensure that goods arrive at the User’s chosen delivery address in the same good order.

In the event that the User should correctly cancel an order through the Provider’s e-commerce facility, the Provider shall refund the User, save for a 10% deduction on the monetary value of the cancelled order, which shall be a fee for the administration costs. The Provider reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User shall receive a full refund with no deductions.

Returns / Refund
In the event that the User is not happy with its online purchase, the User may contact the Provider so that the return of the item may be organized. All complaints shall be made in writing within 5 calendar days of receipt of the purchase. Refunds shall be processed within 10 working days from receipt of the returned purchase. Please note that, in the event that the returned purchase is not received in its original form (i.e. the purchase has been damaged, opened or used), no refund shall be due, owing or payable to the User. Refunds shall not apply to test samples received or sale items.

In the event that the User receives the purchase from the courier in a damaged condition, the Provider may contact the User immediately (i.e. same day as receipt) and provide photographic images of the product. The Provider shall organize a new product, identical to the product purchased, subject to availability. The delivery policy shall, again, apply.

Although seldom charged, the Provider reserves the right to charge a 10% administration fee for returned orders should the returns process incur significant administration expenses.

In the event that the User is not 100% satisfied with its full-size product purchase, email the reasons for dissatisfaction to the Provider on address info@k-beautyhouse.co.za, within 5 calendar days of receipt thereof. Before a return is approved, photographic evidence shall be required to confirm that the item is still in its original sealed packaging. Please allow 10 business days for the return to be processed, once it is received at the Provider’s warehouse. After the User’s return is received and inspected, its refund shall be processed, and a credit shall be automatically applied to the User’s nominated bank account, whichever is preferred. Please note, the original shipping and handling fees are non-refundable and will be deducted off the refund.

Any Credit Card fees charged will not be refunded.

Privacy & E-Commerce
The Website sells Beauty and Lifestyle Products and Goods online. The use of any product bought from the Website is at the User’s (purchaser’s) risk. The User (purchaser) indemnifies and holds the Provider harmless against any and all claims arising from any loss, injury or damages which may be sustained as a result of using the products sold, alternatively information provided on the Website.

The private information required for executing the orders placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address, telephone numbers and e-mail address shall be kept in the strictest confidence by the Provider, and not sold or made known to third parties, save for the necessary information that shall be required to be disclosed to third parties delivering the ordered product(s) to the relevant User (purchaser).

The Provider undertakes that it has taken all reasonable precautions to secure the credit card processing that is carried out to receive payment for goods sold. The Provider shall not, under any circumstance whatsoever, be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on its device.

Communications
By using the Website or communicating with the Provider by electronic means, the User is deemed to have acknowledged and consented to any and all agreements, notices, disclosures, or any other communication satisfying any legal requirement, including but not limited to the requirement that such communications should be in writing.

Updating of these Terms and Conditions
The Provider reserves the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions shall become effective upon such changes being posted to the Website. It is the User’s obligation to periodically check these Terms and Conditions on the Website for changes or updates. The User’s continued use of the Website, following the posting of changes or updates, shall be considered notice of the User’s acceptance to abide by and be bound by the Terms and Conditions, including such changes or updates.

Copyright and Intellectual Property Rights
The Provider shall provide certain information on the Website. Content currently or anticipated to be displayed on the Website is provided by the Provider, its affiliates and/or subsidiary, or any other third party owners of such content, and includes but is not limited to Literary Works, Artistic Works, Sound Recordings, Cinematography Films, Sound and Television Broadcasts, Published Editions and Computer Programs. All such proprietary works, and the compilation of the proprietary works, are either owned by the Provider, its affiliates or subsidiary, or any other third party owner of such rights/copyright (“the Owners”), and is protected by South African and international copyright laws. All rights to the Content are reserved and retained by the Owners. The Provider reserves the right to make any changes to the Website, the Content, or to products and/or services offered through the Website at any time and without notice, except as specified in these Terms and Conditions The User is not granted a license or any other right including but not limited to a right under Copyright, Trademark, Patent or other Intellectual Property Rights in or to the Content.

Limited License to General Users
The Provider grants to the User, subject to the further terms of these Terms and Conditions, a non-exclusive, non-transferable, limited and revocable right to access, display, use, download and otherwise copy the current and future Content for personal, non-commercial and information purposes only.

The Website and the Content may not be reproduced, duplicated, copied, resold, visited or otherwise exploited for any commercial purpose without the express prior written consent of the Provider. The license shall not allow the User to collect product or service listings, descriptions or other information displayed here, and shall not allow any derivative use of the Website or the Content for the benefit of another merchant. The User may not frame nor use framing technologies to enclose the Provider’s Website or the Content nor any part thereof without the express written consent of the Provider.

The Owners, its affiliates or subsidiary reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion. Any unauthorized use terminates this license.

Limitation of liability
The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of the Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if the Provider is expressly advised thereof.

The Provider does not warrant the products and their performance in any form whatsoever. All such warranties may be provided by the manufacturer to the User, but are not endorsed by the Provider.

Website visits
The User may visit the Website without providing any personal information. The Website servers shall in such instances collect the IP address of the User’s computer. This information is used to measure the number of visits, average time spent at the Website, pages viewed, etc. The Provider uses these statistics to determine use of the Website, and to improve content thereon. The Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.
